These General Terms and Conditions (hereinafter: GTC) set out the terms and conditions for the use of the service by the user (hereinafter: “Customer”) on the www.miraclecream.eu website (hereinafter: Website). Seller and Customer are collectively referred to as the Parties.
These terms and conditions are governed by the laws of Hungary!
General information and conclusion of the contract between the Parties
1.1. The scope of this GTC covers all electronic commerce services that take place in the electronic web store on www.miraclecream.eu. In addition, the scope of this GTC shall apply to any commercial transaction between the Parties specified in this Agreement as described in this Agreement.
1.2. Purchase in the Web Store is possible by placing an order in the Web Store by electronic means, as defined in this GTC.
1.3. Anyone is entitled to use the services of the Web Store if they place a valid order with their real data on the Website and successfully acknowledge the terms and conditions of this GTC. The webshop does not contract with minors. By accepting the commercial terms, the customer declares that he is of legal age.
1.4. The language of the contract shall be English, the contract concluded shall be deemed to be in writing. The contract concluded shall not be filed. You can find the current terms and conditions on the website. The order can be modified or canceled freely and without consequences until the commencement of the execution. This can be done by mail and email. If your order has been handed over to the courier service, you will not be able to cancel your order.

- Registration, purchase
2.1 It is possible, but not required, to register in the web shop. After registration, the customer profile also gives you access to other convenience features of the web store, including access to your purchase history and previous purchase information.
2.2 Visitors can register on the shopping cart page. By clicking on the “Create Account” button, you can register. The following personal information is required for registration and purchase: last name, first name, email address, password, telephone number, shipping address, billing address. It is not necessary to activate the registration.
2.3 The user will also be able to log in to the shopping cart at the next purchase by clicking on “Login here” as a registered user. Clicking on the “Change account details” menu item, you will be able to access your user account, where you can edit the data provided during the registration, or you can modify the data, add new data, change the delivery address and change the password. Possibility for the user to subscribe to the webshop newsletter or unsubscribe from the newsletter service.
2.5 In addition to the individual product (s), the Webshop will always contain basic information, information, product prices, product parameters and photos needed to make a customer decision. The prices shown are gross prices which include VAT but exclude shipping. By clicking on the “Cart” button next to the selected products, you can place the selected product in the required amount in the virtual basket of the web store. You can add any product to the cart.
2.6 Once the selected product (s) have been added to the basket, the contents of the basket can be accessed by clicking on the basket in the header. Here you can change the number of items or delete items in the cart.
2.7 To order the products of the shopping cart, press the [Go to Checkout] button to purchase as a registered user or to purchase without registration. If you are already registered with our system, you just need to log in, no need to re-enter shipping details. After selecting payment and shipping, the system calculates the current shipping cost, which is clearly legible. In the last step of the order you have the opportunity to add comments, additional information and requests to the order. Of course, the data can be modified and any typing errors can be corrected by clicking on the appropriate field.
2.8 After the order is placed, our system will send an electronic confirmation to the Buyer’s email address with the details of the order.
2.9 The shipment of the ordered product (s) will be notified by email to our customers. In the case of delivery by courier, we will send you a text message on the day of delivery. Please email firstname.lastname@example.org for more information on orders, or any comments you may have.
2.10 If the webshop fails to fulfill its contractual obligations because of the unavailability of the goods specified in the contract or the inability to provide the ordered service, it shall inform the customer thereof.

3.1 Directly routed credit card payment
The convenient and secure online payment is provided by B-Payment Zrt. Your credit card information is processed in a completely closed system and is not accessible to the www.miraclecream.eu webshop.
3.2 Prepayment to a bank account
The Customer shall pay the Service Provider by transfer to the bank account indicated in the table below the price of the ordered products, before their delivery or receipt. If you choose this payment method, the Customer will in any case wait for the Service Provider to confirm the order, in any case do not initiate the transfer. Please indicate the order number and the name of the customer in the remittance transfer section so that we can accurately identify the transfer.
The Service Provider shall deliver the ordered product to the courier service after crediting the purchase price invoice in each case.
The Service Provider shall provide the Customer with an electronic invoice sent by E-MAIL to confirm the payment on or before the delivery of the ordered products.
4 Delivery time
Delivery time is 3-5 business days. Unless otherwise agreed by the Parties-the Service Provider shall deliver (deliver) the product to the consumer without delay, but no later than thirty days after the conclusion of the contract. In the event of the Service Provider’s delay, the Customer who is a consumer is entitled to set an additional deadline. If the Service Provider fails to perform within the additional deadline, the consumer is entitled to cancel the contract. The consumer shall be entitled to withdraw from the contract without any further limitation if:
- a) the Contractor has refused to perform the contract; or
- b) the contract should have been performed in accordance with the agreement of the parties or due to the recognizable purpose of the service, within a specified period of performance and not at any other time.
5. Right of cancellation, details of cancellation, guaranty, warranty
5.1. If the Customer wishes to cancel the purchase after delivery or receipt of the product, he may do so within 14 calendar days of receipt of the goods without giving any reason. On the detailed rules of contracts between the consumer and the business. (45/2014. II.26. Government Decree).
5.2. Customer may exercise the right of withdrawal from the date of receipt of the goods ordered. In the case of sale of several products, if the delivery of each product takes place at a different time, from the date of receipt of the last product delivered; in the case of a product consisting of several lots or pieces, the customer may exercise his right of withdrawal from the date of receipt of the last lot or piece supplied. Of course, the customer may cancel the purchase of the product at any time before the product is received or shipped, and may notify the service provider or the operator of its intention to do so by e-mail and in writing.
5.3. If the Customer wishes to cancel the purchase, it is sufficient to send the written notice of withdrawal to the Service Provider by mail or e-mail within 14 calendar days of receipt of the product and must return or return the product within 14 days from the date of exercising the right of withdrawal. for the operator.
5.4. Customer may exercise its right of withdrawal either in the form of a clear statement or by using the following template statement:

Important information! Please DO NOT return the package with payee addressed (ie no postage or port service) as we will not be able to pick it up so the package will be deposited at that depot.
The contents of each package are inspected and refunded within 14 days if the package is returned intact.
5.5. In the event of a customer’s cancellation, the service provider shall reimburse the full amount paid by the consumer for compensation, including any costs incurred as a result of the cancellation, without delay and no later than 14 days after becoming aware of the cancellation. If the customer, the consumer, withdraws from the contract as described in this chapter, he must return the product immediately or, at the latest, within 14 days of giving notice of the withdrawal, or return it to the company or its authorized representative.
The service provider may withhold the amount to be reimbursed as a result of the withdrawal until the consumer has returned the product or has unequivocally proven that he has returned it; the earlier of the two shall be taken into account. When refunding, the Service Provider, the Web Store, will use a payment method that is the same as the one used for the original transaction, unless Customer explicitly agrees to another payment method. The Customer will not be charged any additional costs due to the use of the refund method.
5.6 In the event of cancellation, the Consumer, the Customer shall bear only the direct cost of returning the Product.
5.7 The consumer shall only be liable for any diminution in use resulting from use in excess of that necessary to determine the nature, characteristics and functioning of the product. The company may claim compensation for damage resulting from use in excess of the above use and from misuse of the product.
5.8 The consumer, the customer may not exercise his right of withdrawal in our webshop as described in Section 45/2014. (II.26.):
“(E) in sealed product which cannot be returned after opening for health or hygiene reasons after it has been opened;”
In the case of cosmetic-beauty products sold in the webshop, products that come into direct contact with the human body, the removal of the packaging protecting the contents of the product, opening the lid of the hygienically sealed container or visibly changing the content or content may terminate the customer’s right of withdrawal.
5.9 The manufacturer warrants that the products are of good quality. We can only accept a quality objection to a purchased product if the reasons for it are clearly attributable to the product in question, without any outside intervention. www.miraclecream.eu accepts no liability if the manufacturer rejects the complaint about the quality objection. The product warranty does not cover damage resulting from improper use. The warranty does not cover damage caused by external causes (eg accident, lightning, breakage), nor does it cover damage to the products due to external damage, improper use or storage of the product in adverse conditions.
6.1 Purchasing at the Web Store requires the Buyer to be aware of the technical and technical limitations of the Internet and to accept the potential for errors with the technology.
6.2 The Service Provider shall not be liable for any damages resulting from connection to the Web Store. It is the visitor’s responsibility to assess how to protect their data stored on their computer from intruders. The buyer is solely responsible for linking to his webstore and making purchases at www.miraclecream.eu. The operator cannot be held liable in case of force majeure. In particular, faults in the Internet which prevent the smooth operation of www.miraclecream.eu and purchase on the Website, and loss of data sent and received on the Internet in connection with the malfunction shall be considered force majeure. The Service Provider shall not be liable for any damage resulting from joining the Web Store.
6.3 In the event that the visitor breaches any of the terms and conditions of these Terms and Conditions, the operator may freely declare the buyer’s order void and refuse to make a purchase.
6.5 The Contracting Parties shall use their best endeavors to resolve any disputes which may arise through negotiations.
6.6 The Service Provider is entitled to unilaterally modify the terms and conditions of this GTC at any time. Any modification shall take effect at the time of its appearance on the Website.
